Property Agency
Property Agency is at the sharp end of any new legislation in our sector. During the course of 2008 it will become a criminal offence to market a property without obtaining Energy Performance Certification. Obtaining such certification will become part of the marketing process and needs to be completed at the earliest stages of any marketing initiative.
Legal Practice
Solicitors have a duty of care to their client to ensure that an Energy Performance Certificate (EPC) has been made available during the transaction process. During the course of 2008 it will become a criminal offence to complete a property transaction without first obtaining an EPC. Obtaining an EPC will become part of the standard process for documenting property transactions. As with all legal documentation it will be hugely beneficial to ensure an EPC is obtained at the earliest opportunity.
Managing Agents And Facilities Managers
Managing Agents and Facilities Managers will often be the professionals responsible for obtaining an Energy Performance Certificate (EPC) for buildings they manage. Managing Agents and Facilities Managers will also be increasingly asked for the information required to help produce an EPC.
Fund/Asset Managers
Fund/Asset Managers will often be responsible for obtaining an Energy Performance Certificate (EPC) for properties they manage. During the course of 2008 it will become a criminal offence to complete a property transaction without first obtaining an EPC. Obtaining an EPC will become part of the standard process for documenting a property transaction. As with all documentation which is a requirement, it will be hugely beneficial to obtain an EPC at the earliest opportunity.
Landlords/Developers

Obtaining an EPC will become part of the standard property marketing process and needs to be completed at the earliest stage possible of any marketing initiative.
Commercial Occupiers
Companies occupying commercial property will require an Energy Performance Certificate (EPC) in a number of different situations:
1. If the company is marketing surplus business space where they have a residual lease then they will be responsible for obtaining an EPC prior to their agents commencing marketing of the vacant space.
2. More and more frequently National Energy Rating is being asked to provide an EPC for existing occupiers who wish to learn more about the energy performance of their premises. There is no legal requirement for companies to obtain an EPC unless they are marketing business space. However having an EPC prepared for a property will allow for greater energy performance knowledge which can lead to lower energy costs through improvements you make to the building, and there are the obvious benefits of reduced energy consumption leading to lower carbon emissions. An EPC is also a great tool to show your staff and clients that in an age of greater and greater corporate responsibility you as a company are taking initiatives.
Public Sector
From 1st October 2008 all larger Public buildings (over 1000m2) will require a Display Energy Performance Certificate (DEC). The certificate assesses how well the building has been operated based on actual energy consumption information. The DEC needs to be publicly displayed within the building. It is slightly different in form and content to an Energy Performance Certificate. A DEC is produced using a different methodology to an EPC and produces a calculation referred to as an asset rating.
